Introduction
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "you") and Opintu Car Care ("Opintu", "we", "us", or "our"), governing your access to and use of all Opintu services, platforms, applications, and websites (collectively, the "Service"). By accessing, downloading, registering for, or using any part of the Service, you unconditionally accept and agree to be legally bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately cease using the Service.
These Terms supersede all prior oral or written representations and form the entire agreement between you and Opintu. Opintu reserves the right to amend these Terms at any time; your continued use after any amendment constitutes acceptance of the updated Terms.
1. Service Description
Opintu is a technology platform that facilitates the booking of car cleaning, exterior washing, interior detailing, paint protection, pickup-drop, and subscription-based car care services in Jamshedpur, Jharkhand, and selected surrounding areas. Opintu acts as an aggregator and service coordinator. All services are delivered by trained professionals deployed by or affiliated with Opintu.
Opintu reserves the sole and exclusive right to determine the scope, availability, pricing, and geographic coverage of its services at any time and without prior notice. We may add, modify, suspend, or withdraw any service, feature, or offer at our discretion.
2. User Eligibility
You must be at least 18 years of age, possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872, and be a lawful owner, authorized custodian, or authorized representative of the vehicle submitted for service. By using the Service, you represent and warrant that all information provided is accurate, complete, and current, and that you have the legal authority to submit the vehicle for servicing.
3. Account Registration and Security
A valid Indian mobile number is required to register. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account, whether or not authorized by you. You agree to notify Opintu immediately at support@opintu.com if you suspect any unauthorized access to your account.
Opintu shall not be liable for any loss or damage arising from your failure to protect your account credentials. Opintu reserves the right to suspend, restrict, or permanently terminate any account at its sole discretion, including but not limited to accounts that violate these Terms, engage in fraud, or are flagged by automated risk systems.
4. Booking, Pricing, and Payment
- All bookings are subject to slot availability and geographic eligibility at the time of booking.
- Full pre-payment is mandatory to confirm a booking. Unconfirmed bookings are automatically released.
- Listed prices are inclusive of applicable GST and are subject to change without notice. The price displayed at checkout is the price charged.
- Prices may vary based on vehicle type, service location, add-ons, or ongoing promotions.
- We accept UPI, debit/credit cards, net banking, and wallets via Razorpay. Opintu does not store card details.
- In the event of a payment gateway error resulting in a deduction without a confirmed booking, the amount will be refunded within 7–10 business days after verification.
- Confirmation is provided via in-app notification and/or SMS. Email confirmations are indicative only and not a guarantee of service delivery.
- Opintu reserves the right to cancel or refuse any booking at its discretion without prior notice, including suspected fraudulent or duplicate bookings.
5. Cancellation and Refund Policy
- Cancellations made more than 4 hours before the scheduled service time are eligible for a full refund.
- Cancellations made between 1 and 4 hours before the scheduled time will incur a 50% cancellation fee; the remaining 50% will be refunded.
- Cancellations made within 1 hour of the scheduled time or after the professional has departed for the location are non-refundable.
- No-shows — where the customer is unreachable, the vehicle is inaccessible, or the location is incorrect — are treated as same-time cancellations and are non-refundable.
- If the required prerequisites for service (safe parking, water access, electricity access where applicable) are not available on arrival, the booking will be treated as a customer-initiated cancellation and will be non-refundable.
- Refunds, where applicable, are processed to the original payment method within 5–7 business days.
- Opintu may cancel a booking for reasons including adverse weather, safety hazards, professional unavailability, or force majeure events. In such cases, a full refund will be issued, and Opintu's liability is limited solely to that refund.
- Membership and subscription fees are non-refundable once the billing cycle has begun, regardless of usage. Unused visits, benefits, or credits do not carry over and expire at end of the plan period.
6. Pre-Service Customer Responsibilities
The Customer bears sole responsibility for fulfilling all of the following conditions prior to and during service. Failure to comply may result in cancellation without refund and limits Opintu's liability in the event of any dispute.
- The vehicle must be accessible, unlocked (or keys handed over), and positioned in a safe, level area with adequate space for the professional to work.
- Safe parking without obstruction from other vehicles, walls, or structures must be ensured.
- Where required for the booked service, a water source and electrical outlet must be available within reasonable proximity.
- ALL pre-existing damage, scratches, dents, stains, broken parts, interior defects, electrical issues, or other known defects must be disclosed and documented by the Customer BEFORE service commences. Failure to do so will be deemed acceptance that the vehicle was presented in the condition returned.
- All valuables, personal belongings, electronic devices, sunglasses, currency, or items of sentimental value must be removed before the professional arrives. Opintu accepts no liability for any valuables left in or on the vehicle.
- The Customer or an authorized representative must be reachable by phone throughout the service duration.
- Children, pets, or unauthorized persons must be kept away from the service area during the entire service.
7. Vehicle Damage Claims
Opintu takes every precaution to handle vehicles with professional care. However, the following strict conditions apply to any damage claim, and by using the Service you explicitly agree to them.
- Claims must be raised in-app or in writing via email to support@opintu.com within 1 hour of service completion. No claim will be entertained after this window under any circumstances.
- The Customer must submit: (a) timestamped before-service photographs clearly showing the absence of the alleged damage, (b) timestamped after-service photographs showing the alleged damage, and (c) a written description specifying the exact location, nature, and extent of damage. Claims without complete supporting documentation will be automatically rejected.
- Opintu will conduct an internal investigation and provide a response within 72 hours of receiving a complete claim. Investigation findings are final and binding.
- Opintu's maximum liability for any substantiated damage claim is strictly limited to the total service fee paid for that specific booking. Opintu shall not be liable for any consequential, incidental, or indirect losses including but not limited to loss of use of the vehicle, rental costs, diminution of value, or business loss.
- Pre-existing damage — including but not limited to swirl marks, micro-scratches, oxidation, faded paint, rust, worn interiors, or any damage disclosed or reasonably discoverable before service — is categorically not covered.
- Damage arising from defective or deteriorated vehicle materials (e.g., peeling clear coat, brittle plastics, loose trim, degraded rubber seals) is not covered. Opintu's standard products and techniques are safe for vehicles in normal roadworthy condition.
- Opintu is not liable for paint, coatings, or surface damage on vehicles with non-factory paint jobs, wraps, PPF, or modifications that were not disclosed prior to service.
- If a Customer has not complied with all pre-service responsibilities outlined in Section 6, Opintu's liability for any damage claim is fully waived.
- Filing false or frivolous damage claims may result in immediate account suspension and potential legal action.
8. Liability and Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPINTU PROVIDES ALL SERVICES ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. OPINTU EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Opintu does not guarantee: (a) specific cleaning outcomes, stain removal, or odor elimination; (b) exact arrival or completion times; (c) results consistent with Customer expectations where pre-existing conditions of the vehicle prevent such results.
Opintu's total aggregate liability to any Customer for all claims arising out of or related to the Service shall not exceed the total amount paid by that Customer for the specific booking giving rise to the claim.
Opintu is not liable for: (a) acts of God, natural calamities, or force majeure events; (b) damage arising from the Customer's failure to fulfil pre-service responsibilities; (c) theft, vandalism, or third-party damage while the vehicle is parked at or after the service location; (d) mechanical or electrical failures in the vehicle that occur during or after service; (e) any indirect, incidental, special, or consequential damages, loss of profit, or loss of data.
9. Indemnification
You agree to defend, indemnify, and hold harmless Opintu, its directors, officers, employees, contractors, partners, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of or inability to use the Service; (b) your breach of these Terms; (c) any information you provide that is false, inaccurate, or misleading; (d) your vehicle's pre-existing condition; (e) your violation of any applicable law or third-party rights; or (f) your negligence or willful misconduct.
10. Subscription Services
- Subscriptions are charged upfront for the selected billing cycle and auto-renew unless cancelled at least 48 hours before the renewal date.
- Subscription fees are non-refundable once the billing cycle begins, regardless of the number of services used.
- Benefits, service credits, and discounted slots are non-transferable and expire at the end of the plan period. Unused credits do not carry over.
- Opintu reserves the right to modify subscription pricing, included services, or plan terms with 30 days' advance notice. Continued use of the subscription after the notice period constitutes acceptance of the new terms.
- Opintu may terminate a subscription without refund if the account is found to be in violation of these Terms.
11. Intellectual Property
All content, branding, logos, trademarks, software code, databases, designs, images, and text published by Opintu are the exclusive intellectual property of Opintu Car Care and are protected under applicable Indian and international law. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, scrape, create derivative works from, or use any part of the Service or its content for commercial purposes without prior written authorization from Opintu.
12. Prohibited Activities
- Submitting false, misleading, or fraudulent information including false damage claims.
- Using the Service for any unlawful purpose or in violation of applicable laws.
- Harassing, threatening, or abusing Opintu staff, professionals, or other users.
- Attempting to interfere with or disrupt the Service, platform, or associated infrastructure.
- Using automated bots, scrapers, or scripts to access the Service.
- Impersonating any person or entity or misrepresenting your affiliation.
- Reselling, sublicensing, or commercially exploiting Opintu services or content.
- Attempting to obtain refunds or compensation through misrepresentation.
13. Termination
Opintu reserves the right to immediately suspend or permanently terminate your account and access to the Service, without notice and without liability, for any reason including but not limited to violation of these Terms, fraudulent activity, abuse of refund or claims processes, abusive behavior toward professionals, or legal requirements.
Upon termination, your right to use the Service ceases immediately. Opinions retains the right to pursue legal remedies for losses caused by your actions. Termination does not entitle you to any refund of amounts paid.
You may delete your account at any time through the app. Deletion does not entitle you to a refund of any active subscription or unused credits.
14. Dispute Resolution and Arbitration
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the following process applies:
- Step 1 — Informal Resolution: Contact Opintu at support@opintu.com. Opintu will attempt to resolve the dispute within 15 business days.
- Step 2 — Binding Arbitration: If informal resolution fails, the dispute shall be referred to and finally resolved by a sole arbitrator appointed by mutual agreement or, failing agreement, by Opintu, under the Arbitration and Conciliation Act, 1996 (as amended). Proceedings shall be conducted in English and held in Jamshedpur, Jharkhand.
- The arbitrator's decision shall be final and binding on both parties. Each party shall bear its own legal costs unless the arbitrator orders otherwise.
- CLASS ACTION WAIVER: You agree that any dispute shall be resolved solely on an individual basis and not as part of a class action, collective proceeding, or representative action. You waive any right to bring or participate in any class or collective claim.
- Small claims: Either party may bring an individual claim in a court of competent jurisdiction in Jamshedpur for claims within the monetary limits of small claims jurisdiction.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, all disputes shall be subject to the exclusive jurisdiction of the competent courts located in Jamshedpur, Jharkhand, India. You waive any objection to such jurisdiction on grounds of inconvenient forum or otherwise.
16. Modifications to Terms
Opintu may revise these Terms at any time by posting the updated version on the website and app. For material changes, Opintu will provide at least 30 days' notice via in-app notification, email, or SMS. Your continued use of the Service after the effective date of any update constitutes your binding acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
17. Severability and Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Any failure by Opintu to enforce any provision of these Terms shall not constitute a waiver of Opintu's right to enforce such provision in the future.
18. Force Majeure
Opintu shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond Opintu's reasonable control, including but not limited to acts of God, natural disasters, floods, earthquakes, epidemics, pandemics, government restrictions, curfews, strikes, civil unrest, or failure of third-party service providers. In such events, Opintu's obligations are suspended for the duration of the force majeure event.

Binding Agreement
By accessing or using Opintu services — whether through the mobile app, website, or any other channel — you acknowledge that you have read, fully understood, and agree to be legally bound by these Terms and Conditions in their entirety. If you do not agree, you must not use our services.
